Terms of Use

1. Seller and Contact Information

Epochgram is licensed and provided by Andriy Babets (PE) ("Epochgram", "we", "us", or "our").

2. Terms of Use

These Terms of Use ("Terms") govern your access to and use of Epochgram, including the Epochgram website, documentation, and the Epochgram plugin for Obsidian (the "Product").

By accessing, downloading, purchasing, activating, or using the Product, you agree to these Terms. If you do not agree, do not access or use the Product.

3. Orders and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

4. Eligibility

You may use the Product only if you are legally able to enter into a binding agreement.

5. Product License

Subject to these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Product for your personal use or internal business use in accordance with the Product documentation.

The Product is licensed, not sold. No ownership rights in the Product or any related intellectual property are transferred to you.

6. Lifetime License

Unless expressly stated otherwise on the checkout page, Epochgram Pro is sold as a lifetime license for the Product.

For these Terms, "lifetime" means the commercial lifetime of the Product as offered by us, not your lifetime, and does not guarantee indefinite updates, support, or availability of any particular feature, integration, cloud service, or third-party dependency.

7. Device Limit

Unless expressly stated otherwise at checkout, one license may be activated on up to five (5) devices maximum, provided those activations are for the same user.

You may not share, transfer, resell, lease, sublicense, distribute, or otherwise make your license available to any third party.

A purchase does not include any guaranteed right to reset activations, reclaim device slots, or receive additional activations beyond the stated limit.

8. Activation and License Verification

The Product may require activation through our licensing service.

To maintain license validity, the Product may be verified periodically using our cloud licensing service, including up to once per day.

License verification and licensing operations may process data reasonably necessary to validate the license, enforce device limits, prevent abuse, and operate the licensing system. This may include:

  • email address
  • transaction details
  • device identifier
  • IP address and user-agent
  • license key

If we reasonably detect misuse, unauthorized sharing, tampering, circumvention of licensing controls, or use beyond the permitted device limit, we may suspend, restrict, or revoke the license or access to paid features.

9. Acceptable Use and Restrictions

You may not, except where such restriction is prohibited by applicable law:

  • copy, modify, distribute, sell, or create derivative works of the Product
  • reverse engineer, decompile, disassemble, or attempt to discover source code, except to the limited extent such activity cannot legally be restricted
  • bypass, disable, interfere with, or circumvent activation, licensing, access-control, or verification mechanisms
  • use the Product in a way that infringes the rights of others or violates applicable law
  • use the Product to build, provide, or distribute a competing hosted, redistributed, or repackaged version of Epochgram

10. Open-Source and Third-Party Components

The Product may include, depend on, or interoperate with third-party software, open-source components, platforms, APIs, and services. Those components and services may be governed by their own terms, licenses, and privacy policies.

We are not responsible for third-party products or services that are not controlled by us.

11. Updates, Changes, and Availability

We may release updates, patches, fixes, improvements, or new versions of the Product at any time.

Some updates or new versions may require renewed activation or license validation.

We may modify, suspend, or discontinue any feature, integration, or part of the Product, including any cloud-based licensing functionality, at any time, with or without notice.

12. Support

Support, if provided, is offered at our discretion by email at hi@epochgram.com.

We do not guarantee any specific response time, resolution time, or ongoing support period unless expressly stated elsewhere by us.

13. Intellectual Property

The Product, including its software, design, branding, website content, documentation, text, visuals, and related materials, is owned by Andriy Babets (PE) or its licensors and is protected by applicable intellectual property laws.

Except for the limited license expressly granted under these Terms, all rights are reserved.

14. Disclaimer

The Product is provided on an "as is" and "as available" basis.

To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted or error-free operation.

You are solely responsible for maintaining backups of your notes, vaults, settings, files, exports, and any other data used with the Product.

15. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or use, arising out of or related to the Product or these Terms.

Our total aggregate liability arising out of or relating to the Product or these Terms will not exceed the amount you paid for the Product.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is not permitted by applicable law.

16. Termination

These Terms apply for as long as you use the Product.

We may suspend or terminate your license if you materially breach these Terms.

Upon termination, your right to use the licensed Product ends immediately, and you must stop using any paid or licensed parts of the Product.

Sections that by their nature should survive termination will survive, including provisions on intellectual property, disclaimers, limitations of liability, refunds, and privacy.

17. Changes to These Terms

We may update these Terms, the Refund Policy, or the Privacy Policy from time to time by posting an updated version on this page.

The updated version becomes effective when posted, unless a later date is stated.

Your continued use of the Product after the effective date of the updated version means you accept the updated version.

Refund Policy

18. Refunds

If you are not satisfied with your purchase, you may request a refund within fourteen (14) days of the original purchase date.

To request a refund, contact hi@epochgram.com and include the email address used for purchase and any available order details. You may also contact Paddle through its buyer support channels for order-related issues and returns.

Refunds, when approved, are returned to the original payment method.

We may refuse a refund request where we reasonably believe there is fraud, payment abuse, repeated abusive refund behavior, or a material violation of these Terms.

Nothing in this Refund Policy limits any mandatory consumer rights that cannot legally be excluded or limited.

Privacy Policy

19. Scope

This Privacy Policy explains how we process personal data in connection with the Epochgram website, licensing, support, analytics, and sales-related workflows.

20. Data We Process

Depending on how you interact with Epochgram, we may process:

  • your email address
  • transaction details
  • license key
  • device identifier
  • IP address
  • user-agent
  • support communications you send to us
  • website usage and analytics data
  • marketing preferences and subscription status
  • records of consent, opt-in source, and unsubscribe requests

21. How We Use Data

We use personal data to:

  • provide and operate the website and Product
  • activate and verify licenses
  • enforce license limits and prevent fraud, abuse, and unauthorized sharing
  • process and respond to support requests
  • maintain security, diagnose technical issues, and improve the Product
  • keep records related to purchases, licensing, and refunds
  • understand website usage and performance
  • send newsletters, product updates, release announcements, beta invitations, offers, and other marketing communications where permitted by law
  • manage subscriptions, communication preferences, and unsubscribe requests

22. Marketing Communications

If you subscribe through a form on our website or otherwise give consent, we may use your email address to send you marketing communications about Epochgram, including newsletters, product updates, release announcements, beta invitations, tips, and promotional offers.

We send marketing emails only where permitted by applicable law and, where required, based on your consent.

You can unsubscribe from marketing emails at any time by using the unsubscribe link in the email or by contacting hi@epochgram.com.

We may keep a record of your subscription status, consent, opt-in source, and unsubscribe requests in order to demonstrate compliance and respect your communication preferences.

Service-related emails, such as purchase confirmations, license emails, claim keys, support replies, and important account or policy notices, are not marketing communications.

23. Website Analytics

We use Google Analytics on the website to understand traffic, usage patterns, and site performance.

Google Analytics may process information about your use of the website, such as pages viewed, approximate location, device/browser information, and interaction data. We use this information to improve the website and better understand how visitors use it.

You can limit certain data collection through your browser settings, cookie controls, or other privacy tools available to you. Google requires sites using Google Analytics to disclose that Analytics is used and how it collects and processes data.

24. Payments and Paddle

Orders are processed by Paddle.com as Merchant of Record.

When you purchase through Paddle, Paddle processes payment and related transaction data under Paddle's own legal terms and privacy practices. We may receive limited customer and transaction information from Paddle, such as your email address, transaction identifiers, product purchased, and refund or chargeback status, for licensing, fulfillment, recordkeeping, fraud prevention, and customer support.

25. License Verification Data

To operate the licensing system, the Product may periodically contact our licensing service and process information such as:

  • email address
  • transaction details
  • device identifier
  • IP address and user-agent
  • license key

We use this information to validate licenses, enforce device limits, detect abuse, and maintain the licensing infrastructure.

Where applicable, we process personal data as necessary to:

  • perform our contract with you
  • comply with legal obligations
  • pursue our legitimate interests in operating, securing, improving, and enforcing the Product and licensing system
  • obtain and rely on your consent for newsletters, product updates, release announcements, beta invitations, offers, and other marketing communications where required by applicable law

27. Data Sharing

We do not sell your personal data.

We may share personal data with service providers that help us operate the website, analytics, licensing, payments, support, email delivery, marketing communications, hosting, and fraud prevention, but only to the extent reasonably necessary for those purposes.

28. Data Retention

We retain personal data only for as long as reasonably necessary for licensing, support, security, recordkeeping, refund handling, dispute resolution, legal compliance, and enforcement of these Terms.

29. International Processing

Your data may be processed in countries other than your own, depending on where our service providers, infrastructure, analytics tools, or payment providers operate.

30. Your Rights

Depending on your location, you may have rights to request access to, correction of, deletion of, or restriction of your personal data, or to object to certain processing.

You can opt out of marketing emails at any time. Opting out of marketing emails does not affect service-related communications.
